Thank you for choosing to be part of our Mindful Mamas Club community, a part of Otsuka Precision Health (“we”, “us”, “our”). This privacy policy applies to personal information we collect, use and share when you visit our website, https://mindfulmamasclub.com (the “Site”), use our mobile application (the “App”) and more generally, use of our services (the “Services”, which include Site and App). If there are any terms in this privacy notice that you do not agree with, please discontinue use of our Services immediately.
1. WHAT PERSONAL INFORMATION DO WE COLLECT?
The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make and the products and features you use.
Personal Information You Disclose To Us
The personal information we collect varies depending on your interactions with us and may include:
- Contact information such as first and last name, email, and phone number.
- Account and registration information such as first and last name, email, phone number, social media handle, and other information related to your account or registration. When you customize your profile, we collect content choices, and other information you choose to upload, and may offer additional free and fee-based resources through a subscription.
- Communications that we exchange, including information you choose to provide in messages and/or other interactions as part of your use of our Services, any questions, requests, press inquiries, feedback, public posts or otherwise.
- Transaction information as part of your use and interaction with our Services, such as shipping and billing addresses and payment and purchase information including payment card information, which is collected by our payment processors or the app store.
- Event information such as contact information and other information related to your registration for and participation in the events that we host or sponsor.
- Other information that we may collect, which we will process as described in this Privacy Policy or as otherwise disclosed.
All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.
Personal Information Automatically Collected
Like many businesses, we automatically collect certain information when you visit, use or navigate the Services including through cookies and similar technologies as described below. This information may include device, log and usage information, such as your IP address, browser type, settings and device characteristics, operating system, language preferences, referring URLs, device name, country, location information based on your IP address, information about how and when you use our Services and other information such as the date/time stamps associated with your usage, pages and files viewed, searches and features you use, and device event information such as system activity, error reports and settings. If you use our App, we may request access or permission to certain features from your mobile device, including your mobile device’s microphone, storage, camera, reminders, photo library, SMS messages, and other features such as notifications or alerts. If you wish to change our access or permissions, you may do so in your device’s settings.
We may also collect your personal information using AI Tools (software applications that incorporate AI technology). Our AI Tools may be used to collect your personal information, such as when you directly provide it using prompts or questions, or uploading documents or other content into an AI Tool. The AI Tool may process this personal information.
Personal Information Collected from Third Party Sources
We may collect personal information about you from third party sources such as public databases, advisors and agents, affiliates and subsidiaries, internet service providers, operating systems and platforms, data brokers and analytics providers, marketing companies, business partners, clients, social media platforms, or other third parties or vendors. We may combine the personal information that we receive from you with personal information and other information that we obtain from other sources. We may receive lead and prospect information, such as names, email addresses and contact information from third parties about individuals who may be interested in engaging with us.
Public Information
If you post information about us or engage with us on third party platforms, we may collect personal information about you from that third party platform or account. These third-party platforms and services control the information they collect and share about you. For information about how they may use and disclose your personal information, including any personal information you make public, please consult their respective privacy policies.
2. HOW WE USE PERSONAL INFORMATION
We use personal information for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations.
We use the personal information we collect or receive:
- To administer the Services. We use your personal information to provide the Services, such as when you interact with and contact us. If you choose to link your account with us to a third-party account (such as your social media account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process for the performance of the contract.
- To communicate. Your personal information is used to communicate with you, to respond to inquiries, to provide support, to request feedback and to provide product, service and new feature information and/or information about changes to our terms, conditions, and policies.
- To send you marketing, advertising and promotional information. We and/or third-party advertisers and ad networks may use personal information for marketing, advertising, and measurement purposes and to develop and display personalized content and advertising tailored to your interests and to retarget you on other websites.
- To post testimonials. We post testimonials on our Services that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and the content of the testimonial. If you wish to update or delete your testimonial, please contact us and be sure to include your name, testimonial location, and contact information.
- To develop, improve, and personalize our products and services. We may use your personal information to perform data analysis, identify usage trends, and to evaluate and improve our Services, products and your experience. We may also use your personal information to market our products and services, including marketing of products and services targeted to you. We may also use and store this information in aggregated or deidentified forms (which is described below in How We Disclose Personal Information).
- To protect rights and services. We may use your personal information as part of our efforts to keep you, third parties, us and our Services safe and secure (for example, for fraud monitoring and prevention, to detect unauthorized activities and access, and other misuse, where we believe necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party, or violations of our terms or policies including this Privacy Policy).
- To prevent harm, comply with legal and regulatory requirements or in connection with a contract. To comply with the legal and compliance obligations, to respond to legal process and related to legal proceedings. For example, we may disclose information in response to subpoenas, court order, and other lawful requests by regulators and law enforcement, including responding to national security or law enforcement disclosure requirements. We may also disclose information, including personal information, related to litigation and other legal claims or proceedings in which we are involved, as well as for our internal accounting, auditing, compliance, recordkeeping, and legal functions. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.
With your consent, or as otherwise disclosed at the time your personal information may be collected by AI Tools in connection with our Services, we may use your personal information processed by AI Tools for the following purposes:
- To process payments and to provide and improve user support;
- To understand your preferences and tailor your responses in connection with our Services;
- To operate, customize, and improve our AI Tools, including analytics; and
- To detect fraudulent and suspicious transactions and activities.
3. HOW WE DISCLOSE PERSONAL INFORMATION
We may disclose personal information to the following parties including:
- Vendors and service providers. We may disclose personal information to entities and individuals that provide services on our behalf or help us operate the Site or Services (such as information technology, hosting, customer support, etc.).
- Third parties. We may work with other entities to partner with, provide or promote our Services. Please note that personal information collected during joint registrations may be collected under this Privacy Policy, the privacy policy of the other entity, and/or the privacy policy you see when you register. Links from our Site to a third party’s website are also governed by the third party’s privacy policy which we urge you to read carefully.
- AI tools and third parties. Our AI tools may use language models and technology licensed from third parties, or our Services may include third party software that use, stores, and processes language models. To operate our AI Tools, we may share data you entered into them with these third parties. We require these third parties to keep your personal information secure, and we do not permit them to use or share your personal information for any purpose other than providing our Services. Marketing, advertising and analytics providers. We and third-party marketing, advertising, and analytics providers collect personal information to implement and evaluate our Site and Services and for advertising, analytics, measurement and marketing purposes. The personal information is collected through cookies and other tracking technologies via our Site.
- Professional advisors. We may share personal information with professional advisors, such as lawyers, auditors, bankers and insurers where necessary in the course of the professional services that they render to us.
- Authorities and others. We may share personal information with law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or as legally required for compliance and protection purposes.
- Business transfers. We may share personal information with relevant participants in business transactions (or potential transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets.
- Others as permitted by applicable law. We may also disclose personal information to third parties to the extent permitted by applicable law and legal obligations. This may include regulators, government entities, and law enforcement as required by law or legal process. In addition, it may include certain disclosures that we are required to make, such as the names of sweepstakes and contest winners, which may be made public in some jurisdictions.
- Aggregated and de-identified information. We may disclose aggregated and de-identified information for marketing, advertising, research, or other purposes. We may use this data and share it with third parties for our lawful business purposes, including to analyze and improve the Site and promote our business and Services. Once we aggregate or de-identify your personal information, we will not attempt to re-identify you unless we are required to or permitted by applicable laws.
We do not share your personal information with vendors or service providers for their direct marketing purposes.
4. COOKIES AND OTHER TRACKING TECHNOLOGIES
Mindful Mamas Club uses various technologies to collect and store information, including cookies, pixel tags, local storage, such as browser web storage or application data caches, databases, and server logs (which we will collectively refer to as “cookies”).
- Cookies. Cookies are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating analytics activities.
- Web beacons, pixel tags, and similar technologies. Web beacons are tiny graphics with a unique identifier, similar in function to cookies, which are embedded invisibly on web pages. We or our service providers may use web beacons (also known as clear GIFs, web bugs, pixel tags, or action tags, among other names), in connection with our Site to perform functions like tracking the activities of visitors to our Site, helping us manage content, and compiling statistics about usage of our Site and Services. We or our third-party providers may also use pixel tags in emails to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.
- Embedded scripts and Software Development Kits (“SDKs”). SDKs allow us to build and integrate custom experiences on our digital properties. Embedded scripts are temporarily downloaded onto your device from our web server, or from a third party with which we work, and are active only while you are connected to our digital properties and are deleted or deactivated thereafter. SDKs function like pixels and cookies but operate in the mobile app context. The primary app developer can install pieces of code (the SDK) from partners in the app, which allows the partner to collect certain information about user interaction with the app and information about the user device and network information.
- Local storage. Local storage refers generally to other places on a browser or device where information can be stored by websites, ads, or third parties, e.g. HTML5 local storage and browser cache.
- Analytics. We and third parties use cookies and other tracking technologies to evaluate how visitors interact with our Site. We use these tools to help us improve our Site, performance, and user experience.
- Social Media. Our Site may include social media features offered by third parties such as Facebook and Instagram. These features may collect electronic and other internet activity information, such as your IP address and which page you are visiting on our Site. These widgets may set a cookie or utilize other tracking technologies to accomplish this. Social media features and widgets are hosted by a third party and your interactions with those features are governed by the privacy policies of the companies that provide them.
We may use both first-party tracking technologies, which are set by us, and third-party tracking technologies, which are set by other parties. Some of the tracking technologies we use may last solely for your browsing session and are deleted when you close your browser, while others are persistent and stored after you close your browser.
Types of Data Collected:
The personal information collected by these tracking technologies may include (a) your internet protocol (IP) address, unique device identifiers, location, browser type, and Internet service provider information; (b) information about when and how you access and use our websites or Services, such as the domains you visit, what features you used and for how long, the website that referred you to us, and date/time stamps associated with your usage; (c) information about the device you use to access the websites or Services, such as device type, device ID, and device/browser settings; and (d) location of the device used to access the websites or Services derived from GPS or WiFi use.
Disclosures of Data:
We may disclose data collected through tracking technologies to the following types of recipients or allow the following recipients to directly collect data using tracking technologies:
- Analytics providers (including providers of ad tracking and reporting services);
- Security providers; and
- Other technology providers who act as our service provider.
Your Choices:
You can control how we use cookies and other tracking technologies. Please be aware that if you disable the use of tracking technologies, the functionality of our digital properties may be negatively affected, and certain areas or features may not display or work correctly.
- Preference Center. We may give you the option of adjusting your preferences about the categories of technologies we use. When this option is available, you can configure your personal settings on our Cookies Banner and Pop Up on our Site or that may be presented as you use our Services. If you use a different device to access the same digital service, you may need to manage your settings for each separate device you use.
- Browser Settings. If you want to disable the use of certain specific tracking technologies or remove them from your device, you can disable or delete them using your browser settings. Please be aware that not all tracking technologies can be deleted through browser settings.
5. INTERNATIONAL TRANSFERS
If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed by us in our US facilities and by those third parties with whom we may share your personal information in the United States and other countries. If you are a resident in the European Economic Area (EEA) or United Kingdom (UK), then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country.
6. RETENTION
We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as safety, security, tax, accounting or other legal purposes). We may retain some information in our files such as to prevent fraud, troubleshoot problems, assist with any investigations, enforce our terms and/or comply with applicable legal requirements.
7. SECURITY
We employ a number of measures designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your personal information. There are also certain steps you can take to better protect against unauthorized access to your personal information. For example, you should choose a strong password that is unique and not reuse passwords across multiple websites and services or share your password with others.
8. MINORS
We do not knowingly solicit personal information from or market to children under 18 years of age. If you believe that we have collected personal information from minors in violation of applicable law, please contact us as described below in Section 12.
9. YOUR PRIVACY CHOICES
Account Information. If you would like to review or change the information in your account or terminate your account, you may be able to log into your account settings and update your user account or contact us using the contact information provided below.
Opting out of Email Marketing. You may opt out of marketing emails by following the opt-out or unsubscribe instructions at the bottom of the email or by contacting us. You may continue to receive service-related and other non-marketing emails or communications.
SMS Communications. You can opt out of receiving marketing and other texts from us by replying OPT OUT or STOP to any text we send to you.
Cookies. Most browsers let you remove and/or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all functionality of the Services, and the Services may not work properly. Analytics. We and third-party analytics providers use cookies and tracking technologies. You may adjust your cookie settings by following the directions directly above. You must opt out on each browser and on each device.
Do Not Track. Some internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” or similar signals.
Decline to Provide Information. We need to collect personal information to provide certain services. If you do not provide the information requested, we may not be able to provide those services.
Privacy Rights. Based on the applicable laws of where you live, you and/or your authorized agent may have the right to request know, access, change, delete or stop us from processing personal information in some circumstances. Please contact us as described in Section 12.
No Discrimination or Retaliation. When exercising your privacy rights, we do not discriminate or retaliate against residents who exercise any of their rights described in our Privacy Policy. Your exercise of these rights will have no adverse effect on your ability to interact or engage with our Services or the quality of our products and services.
10. EXTERNAL LINKS
Our Services may contain links to third-party websites or features. Any access to and use of such linked websites or features is not governed by this Privacy Policy but instead is governed by the privacy policies of those third parties. We are not responsible for the information practices of such third parties, including their collection of your personal information. We encourage you to review the privacy policies and terms for any third-party websites before proceeding to those websites or using those features.
11. UPDATES
We may update this privacy notice from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.
